What is Res Gestae? Edit

Res gestae is where things are considered to be part of and not distinct from the matter in question because they have a very close connection either in time or space. Another term used is ‘spontaneous statements’.

How Res Gestae is used Edit

Res gestae hearsay evidence will be admitted because being made at the same time as the event makes it reliable. The judge must consider whether there is real chance that the material was falsely made up. It will be a matter for the judge to decide the reliability of the statement based on when it was made and how the person was involved.
